After a trademark application is filed, a Trademark Examiner reviews it. If they find it is too similar to an existing mark (Section 11) or is too generic/descriptive (Section 9), they issue an “Examination Report” with an objection. A “Trademark Objection Reply” is a formal legal response drafted to argue why the mark is unique and deserves registration. This must be filed within 30 days of receiving the report, failing which the application is marked as “Abandoned.”
Eligibility & Criteria
- Forms: E-Response through the IP India Portal (No specific government fee for the first reply, but extension requires TM-M).
- Penalty for Delay: The application is permanently Abandoned if not replied to within 30 days.
